These Terms of Service ("Terms") govern your access to and use of the services provided by Vitalize Sales LLC, operating as Samoya ("Samoya," "we," "us," or "our"), including our website at samoya.com and all consulting, systems architecture, automation, and implementation services we offer. By accessing our website or engaging our services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or services.
Samoya provides systems architecture, CRM implementation, marketing automation, pipeline engineering, and related consulting services to business owners and entrepreneurs ("Clients"). The scope of any engagement is defined in a separate proposal or statement of work. We reserve the right to refuse service at our sole discretion.
By providing your mobile phone number and opting into SMS communications, you expressly consent to receive text messages from Vitalize Sales LLC (Samoya) at the number provided. Messages may include appointment reminders, scheduling confirmations, project updates, follow-up communications, and promotional messages related to our services.
Message frequency varies based on your engagement with Samoya. You may receive up to 4–8 messages per month depending on active project status.
Message and data rates may apply depending on your mobile carrier and plan. Samoya is not responsible for any charges incurred from your carrier.
You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive one final confirmation message and no further SMS communications will be sent, unless you re-opt in.

SMS messaging is available through most major U.S. wireless carriers. Samoya does not guarantee delivery of messages through all carriers. Carriers are not liable for delayed or undelivered messages.
You agree not to use SMS communications from Samoya for any unlawful purpose or in violation of any federal, state, or local regulations, including but not limited to the Telephone Consumer Protection Act (TCPA).
All content on samoya.com is the property of Vitalize Sales LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or modify any content without our prior written consent. Work product created during an engagement becomes the Client's property upon full payment. Proprietary methodologies and frameworks developed by Samoya remain our exclusive property.
Payment terms for all engagements are outlined in the applicable proposal or agreement. Unless otherwise agreed in writing:
If your system is not saving you measurable time within 30 days of go-live, Samoya will rebuild or modify the system at no additional cost until it does. This guarantee applies to clients who have completed full onboarding, provided timely access to all required accounts and tools, and participated in required training sessions. The guarantee does not apply to delays or failures caused by the client's failure to follow documented operating procedures.
Both parties agree to keep confidential all non-public information shared during an engagement. Samoya will not disclose your business information to third parties without your consent, except as required by law or to fulfill the engagement (e.g., platform integrations).
To the maximum extent permitted by law, Vitalize Sales LLC's total liability for any claim arising from our services shall not exceed the total fees paid by you in the three months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, profits, or data.
Our services are provided "as is" without warranty of any kind. While we make every effort to deliver high-quality work, we do not guarantee specific business outcomes, revenue results, or performance metrics. See our Earnings Disclaimer for more information.
You agree to indemnify and hold harmless Vitalize Sales LLC, its officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of our services after such changes constitutes acceptance of the revised Terms.
